When to Provide a Long Term Disability Employee Claim Packet

An LTD Employee Claim Packet must be provided to the employee if any of the following apply:

The employee has been approved for full-time or intermittent Family and Medical Leave (FMLA) due to their own medical condition 

The employee has been approved for full-time or intermittent medical leave of absence based on a medical condition 

The employee has filed a Workers’ Compensation claim or has begun receiving Workers’ Compensation benefits 

The employee is working in a different job due to a medical condition 

The employee is working limited duty (meaning they are unable to perform the usual duties of their occupation due to restrictions or limitations as directed by an attending physician) 

The employee is working a restricted schedule due to a medical condition 

The employee is unable to work due to illness or injury

The Employer is responsible for recording the date the Employee Claim Packet is provided and ensuring that this date is recorded in the employee's personnel file. Accurate documentation is necessary to ensure the member has met the statutory requirements for timely filing. 

The LTD Administrator, not the employer, determines the employee’s eligibility for LTD benefits. As the employer, please refrain from making any medical eligibility determinations when providing an employee with a packet.
